What is Temporary Business Relation? / In Which Conditions Can Temporary Business Relation be Established?

With the amendment made in Article 7 of the Labor Law No. 4857, a temporary business relationship can be established through the 'Private Employment Agency' or by appointment within the holding institution or by assigning at another workplace that is an affiliate of the company group.

The purpose of Temporary Work Relation is to solve the periodically required labor requirement with flexible working model without requiring full time employment.

Temporary employment relationship through private employment agency, can be realized as private employment agency authorized by the Turkish Employment Organization makes a temporary employment contract with an employer transfers a worker to the employer temporarily;

a) In the cases referred to in article 74 and item 5 of Article 13 of this Law, in the case of workers' military service and other cases where the employ-ment contract is suspended (in cases of annual leave, sickness and unpaid leave),
b) In seasonal agricultural works,,
c) In domestic services,
d) In works which are not counted as everyday works of the enteprise and are realized with intervals,
e) In case of works which are urgent with regards to occupational health and safety, or if there are compelling reasons that have an impact on the production significantly,
f) In case the average production of goods and services of the enterprise increases in a way that will require the establishment of a temporary business relationship as not being predicted before.
g) It can be established in case of increase in periodical business as excluding seasonal jobs.

In relation to the subclause (f) of the relevant regulation, there is a restriction that the relevant figure can not exceed a quarter of the number of existing employees. However, in establishments employing ten or fewer workers, temporary work relations can be established up to five workers. In deter-mining the number of workers, if there are employees working according to the part-time job contract, calculation should be done by converting their working periods to full-time working.

Temporary worker procurement contract (may be established (a) for as long as the conditions specified in (a) subclause continue, for infinite period in cases specified in subclauses (b) and (c) and for a period of maximum four months for other cases . This contract that is executed may be renewed up to two times in total not exceeding eight months excluding the second paragraph (g) of this contract. The employer who employs a temporary worker can not re-employ a temporary worker until six months have elapsed for the same work.
